Approval / Renewal of Fire NOC


Basic Information:


As per Haryana Fire Service Act, 2009, any person proposing to construct a building to be used for any purpose other than residential purpose or a building proposed to be used for residential purpose of more than 15 meters in height, such as group housing, multi-storeyed flats, walk up apartments, etc. before the commencement of the construction, shall apply for the approval of Fire Fighting Scheme conforming to national Building Code of India, the Disaster Management Act, 2005 (53 of 2005), the Factories Act, 1948 (Act 63 of 1948) and the Punjab Factory Rules, 1952, and issue of no objection certificate on such form, alongwith such fee, as may be prescribed.


Fee Details – There are no charges/ fee for the approval/renewal of Fire NOC.


Time Period – Time period for the approval of Fire Fighting Scheme is 60 days as per Haryana Fire Act, 2009 and Right to Service Act, 2014.


Grievance – In case the fire fighting scheme is not approved with in 60 days then appeal can be made to first appellate authority  Director Urban Local Bodies Bays 11-14 Sector -4 Panchkula where as Second appellate authority is Additional Chief Secretary to Govt. Haryana Urban Local Bodies Department as per Haryana Right to Service act, 2014

Procedure for obtaining approval for Fire NOC:

The step by step procedure to be followed by applicant for filling the application form for Fire NOC is attached as – (the procedure also includes the screenshots of internal processing of application by the department)

Once the application is submitted by the applicant, the following process is followed by the department to grant approval for Fire NOC.

Step – 1 Scrutiny - Online application along with documents submitted is checked and verified by the clerk of concerned MCs.
Step- 2 In case any discrepancy is found in the application and documents, the case is put on hold by the clerk with intimation to the applicant for re- submitting the corrected documents
Step- 3 The applicant will revert to on hold application and submit the requisite information.
Step- 4 Once the application is duly scrutinized, the application and documents is forwarded to the Assistant Divisional Fire Office- ADFO / Fire Station Officer – FSO(Verifier)of Concerned MCs to the applicant.
Step- 5 Inspection- The ADFO / FSO will visit the unit and check the fire equipment’s submitted by the applicant and upload the inspection report/comments within 48 hours on the web portal.
Step- 6 The application will go to Commissioner of Municipal Corporations / Deputy Commissioners(Approver) of Districts on the recommendations of ADFOs/FSOs(15-days, after the receipt of file, whereas Committee comprising concerned ADFO and two other FSOs of the area will scrutinize the case in fifteen days.)
Step- 7 New Fire NOC- of the buildings having plot area and heights not covered in the table as mentioned above will be issued by the Director of Fire Service. The inspection report along with photographs and Video recording (CD) will be submitted by the concerned ADFO/SFO in the Directorate of Fire Service.
Step- 6 Renewal- As far as renewal of Fire NOC is concerned, the ADFO/FSO will renew the fire NOCs for the buildings situated in any area (Rural or Urban), whose power of issuing NOC/ renewal rests with ADFO/FSO whereas in all other cases the power of renewal of NOCs will lie with Commissioner of Municipal Corporations /Deputy Commissioner of Districts on the recommendations of ADFO/FSOs.
Step- 7Final certificate - The final certificate for Fire NOC will be issued online by the Concerned Officer( Commissioner of MC for Districts and Deputy Commissioner in case the District MC doesn’t exist0
Note -It would be appropriate to reiterate that Commissioners of Municipal Corporations will issue the approval of Firefighting schemes as well as NOCs & Renewal of NOCs of the buildings within the limits of the concerned Districts (Rural or Urban), as per delegation of powers issued vide Memo No. DFS/FA-2014/8683-834 dated 12.02.2014 and the Deputy Commissioners will issue such approval of firefighting scheme and NOCs & Renewal of NOCs in which District Municipal Corporation does not exist.

*Note: DD(Tech)/ADFO/FSO means the Deputy Director (Technical), Assistant Divisional Fire Officer & Fire Station Officer respectively. Where the post of ADFO doesn’t exist then senior most Fire Station Officer will be the competent authority in place of ADFO.
